1. Agreement to Terms

By accessing or using mockingly.ai (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Service. The Service is operated by Appsy Studio, a sole proprietorship (eenmanszaak) registered in the Netherlands (KVK 97901946).

2. Service Description & AI Disclaimer

mockingly.ai is an AI-powered platform for practicing system design interviews. The Service provides simulated interview experiences using artificial intelligence for educational and practice purposes.

Important: You are interacting with artificial intelligence, not human interviewers. All interview feedback, analysis, and scoring are AI-generated and may contain errors, inaccuracies, or biases. The Service is an educational and practice tool — it is not a professional hiring assessment, career counselling service, or guarantee of interview success. AI-generated feedback should not be relied upon as the sole basis for career decisions. We do not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated content.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to notify users of significant changes.

3. User Accounts

You must be at least 16 years old to use this Service, as required by Dutch law (UAVG). You sign in using Google OAuth and are responsible for maintaining the security of your Google account. You are responsible for all activities that occur under your account. You must provide accurate information and not impersonate others. We may suspend or terminate accounts that violate these Terms.

4. Subscriptions, Payment & Cancellation

Plans. The Free plan provides unlimited AI interview practice at no cost. The Pro plan costs $14 per month, billed monthly via Stripe, and includes detailed analysis, company-specific questions, trivia quizzes, and priority support. Prices are inclusive and final. No VAT is charged (Appsy Studio operates under the Dutch KOR kleineondernemersregeling scheme).

Billing. Payments are processed securely by Stripe. We do not store your payment card details. Pro subscriptions auto-renew monthly until cancelled. You can cancel at any time and will retain access to Pro features until the end of your current billing period.

EU Right of Withdrawal. As a consumer in the European Union, you have a 14-day right of withdrawal from the date of purchase, in accordance with the EU Consumer Rights Directive and Dutch law (Art. 6:230o BW). However, by upgrading to Pro and immediately accessing Pro features, you explicitly consent to the immediate provision of digital content and acknowledge that you waive your right of withdrawal once the digital service has been fully provided during that period, in accordance with Article 16(m) of the Consumer Rights Directive. If you have not yet accessed any Pro features, you may contact us within 14 days of purchase for a full refund.

Refunds. Beyond the 14-day cooling-off period described above, subscription fees are non-refundable. You may cancel at any time and continue to use Pro features until the end of your current billing period.

5. Intellectual Property

All platform content — including text, graphics, logos, UI design, question banks, and software — is the property of Appsy Studio and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

You retain ownership of the content you create during interview sessions (drawings, messages, solutions). By using the Service, you grant us a limited license to process this content solely for the purpose of providing and improving the Service, as described in our Privacy Policy.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Attempt to reverse engineer, decompile, or extract the source code of the Service
  • Scrape, crawl, or otherwise collect content or data from the Service in an automated manner
  • Interfere with or disrupt the integrity or performance of the Service
  • Share, resell, or redistribute your account or access credentials
  • Upload malicious content or attempt to exploit the AI system
  • Use the Service to generate content that is harmful, misleading, or infringes on third-party rights

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Service is provided on an “as-is” and “as-available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We are not liable for any decisions you make based on AI-generated feedback, interview scores, or analysis provided by the Service.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill. Our total aggregate liability to you for any claims arising from or related to the Service shall be limited to the total fees you have paid to us in the 12 months preceding the claim, or €50, whichever is greater.

Nothing in these Terms excludes or limits our liability for (i) intentional misconduct (opzet) or gross negligence (grove schuld), (ii) death or personal injury caused by our negligence, or (iii) any other liability that cannot be excluded or limited under Dutch law. Consumer rights granted by mandatory Dutch or EU law are not affected by these Terms.

8. Indemnification

You agree to indemnify and hold Appsy Studio harmless from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights. This indemnification obligation does not apply to the extent that the claim arises from our own negligence or intentional misconduct.

9. Changes to the Service & Terms

We may modify, update, or discontinue features of the Service at any time. For material changes that significantly affect your use, we will make reasonable efforts to provide advance notice. We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and notify registered users via email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Termination

You may stop using the Service and delete your account at any time via the Privacy Settings page. We may suspend or terminate your access if you violate these Terms, with or without notice depending on the severity of the violation. Upon termination, your right to use the Service ceases immediately. You may request a data export before termination via your account settings. Provisions that by their nature should survive termination (including limitation of liability, indemnification, and governing law) shall survive.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these Terms shall be submitted to the exclusive jurisdiction of the District Court of Amsterdam (Rechtbank Amsterdam). If you are a consumer residing in the European Union, this choice of jurisdiction does not affect your right to bring proceedings in the courts of your country of residence, in accordance with mandatory EU consumer protection law. You may also use the EU Online Dispute Resolution platform.

12. General Provisions

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Appsy Studio regarding the Service. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. We may assign our rights and obligations under these Terms; you may not assign yours without our written consent.
